By creating an account or using our services, you agree to these Terms.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1. Definitions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>PeopleWisher<\/strong>, <strong>we<\/strong>, <strong>our<\/strong>, or <strong>us<\/strong> refers to PeopleWisher and its operators.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Services<\/strong> means our website, applications, APIs, integrations, messaging tools, contact management tools, and automated greeting services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>User<\/strong>, <strong>you<\/strong>, or <strong>your<\/strong> means any individual or organization using PeopleWisher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Contact<\/strong> means any person whose information is stored within your PeopleWisher account.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Account Responsibilities<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for maintaining the security of your account credentials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for all activity that occurs under your account, including activity by employees, contractors, team members, or other authorized users.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must provide accurate registration information and keep your account information up to date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may not create accounts using automated methods, bots, or false information.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Contact Data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for ensuring that you have the legal right to store, manage, and communicate with your contacts through PeopleWisher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You represent that any contact information uploaded to PeopleWisher has been collected and processed in accordance with applicable laws and regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">PeopleWisher acts as a service provider and processor of contact data on your behalf.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. Messaging Services<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PeopleWisher enables the scheduling and delivery of messages through channels that may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Email<\/li>\n\n\n\n<li>SMS<\/li>\n\n\n\n<li>WhatsApp<\/li>\n\n\n\n<li>Other communication channels we may support in the future<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Delivery of messages depends on third-party providers and network operators.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We do not guarantee that every message will be delivered successfully or received by the intended recipient.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. Payments and Billing<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Paid subscriptions are billed in advance on a recurring basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By subscribing to a paid plan, you authorize PeopleWisher to charge your selected payment method.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for maintaining accurate billing information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All fees are exclusive of taxes unless otherwise stated.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Subscription Changes and Cancellation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You may upgrade, downgrade, or cancel your subscription at any time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you cancel a subscription, your paid features will remain active until the end of your current billing period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unless required by law, subscription fees are non-refundable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We do not provide refunds for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Partial billing periods<\/li>\n\n\n\n<li>Unused subscriptions<\/li>\n\n\n\n<li>Unused message credits<\/li>\n\n\n\n<li>Failure to use the service<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We may issue refunds at our sole discretion in cases involving duplicate charges or billing errors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. Fair Usage<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To maintain platform reliability, we may impose reasonable limits on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>API usage<\/li>\n\n\n\n<li>Contact imports<\/li>\n\n\n\n<li>Message volume<\/li>\n\n\n\n<li>System resources<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We may temporarily restrict excessive activity that negatively affects platform performance or security.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. Acceptable Use<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You agree not to use PeopleWisher to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Violate any law or regulation<\/li>\n\n\n\n<li>Send spam or unsolicited communications<\/li>\n\n\n\n<li>Upload malicious software<\/li>\n\n\n\n<li>Attempt unauthorized access to systems or accounts<\/li>\n\n\n\n<li>Harass, abuse, or deceive individuals<\/li>\n\n\n\n<li>Interfere with the operation of the platform<\/li>\n\n\n\n<li>Circumvent platform limitations or security controls<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We reserve the right to suspend or terminate accounts engaged in prohibited activities.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">9. Third-Party Services<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PeopleWisher may integrate with third-party services including email providers, SMS gateways, WhatsApp providers, CRM systems, and payment processors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your use of those services remains subject to their respective terms and policies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">PeopleWisher is not responsible for interruptions, limitations, or changes imposed by third-party providers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">10. Privacy and Security<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We implement reasonable technical and organizational measures to protect customer data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By using PeopleWisher, you agree to our Privacy Policy and the processing of information necessary to provide the Services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may access account information:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>With your permission<\/li>\n\n\n\n<li>To provide support<\/li>\n\n\n\n<li>To maintain security<\/li>\n\n\n\n<li>To comply with legal obligations<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">11. Intellectual Property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PeopleWisher and all related software, branding, designs, content, and technology remain the exclusive property of PeopleWisher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms do not grant ownership rights to users.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You retain ownership of your contacts, message templates, and other content you upload.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">12. Service Availability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PeopleWisher is provided on an &#8220;as available&#8221; and &#8220;as is&#8221; basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While we strive for reliable service, we do not guarantee uninterrupted availability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Scheduled maintenance, upgrades, third-party outages, or unforeseen events may affect service availability.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">13. Limitation of Liability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To the maximum extent permitted by law, PeopleWisher shall not be liable for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Lost profits<\/li>\n\n\n\n<li>Lost revenue<\/li>\n\n\n\n<li>Lost business opportunities<\/li>\n\n\n\n<li>Lost data<\/li>\n\n\n\n<li>Indirect or consequential damages<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Our total liability arising from your use of the Services shall not exceed the amount paid by you to PeopleWisher during the twelve months preceding the claim.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">14. Termination<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We may suspend or terminate your account if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You violate these Terms<\/li>\n\n\n\n<li>Your use creates security or legal risks<\/li>\n\n\n\n<li>We are required to do so by law<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Upon termination, access to the Services may be removed and stored data may be deleted according to our retention policies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">15.
